As a former entrepreneur I understand the tension between properly protecting your intellectual property and the need to keep costs down.  As a registered practitioner I am authorized, in the same manner as a patent lawyer is, by the U.S. Patent and Trademark Office to work with you to perfect your intellectual property rights as it relates to patents. A patent agent provides legal services specifically related to advice and assistance in creating patent applications and pursuing obtaining a U.S. patent for you. This may often be at rates less than that of a patent attorney. Of course, I recommend that you contact an attorney for any matters requiring their services.

What Patent Agents Do and Don't Do

You may not be familiar with the registration requirements and role of patent agents. We are subject to the same scientific educational criteria, disciplinary and ethical cannons and rigorous enrollment process - including passing the identical specialized bar exam as required to be a patent attorney.

Attorneys are uniquely licensed by individual States to perform legal services. However, registered agents and registered attorneys have equivalent standing with the patent office regarding:

  • searching prior art (no registration needed),
  • working with inventors and organizations to assess  patentability,
  • drafting patent applications,
  • prosecuting patent applications through the entire USPTO process,
  • representing clients in USPTO appeal hearings.
